FAQ on Birth Certificate for Expats' Children in Vietnam
Can we apply for a Birth Certificate without registering our marriage and include the father's details?
Yes, you can. If your spouse is a foreigner and you are Vietnamese but have not registered your marriage, you must first complete the parentage certification procedure (especially if the father is a foreign national). After that, you can proceed with the birth registration for children born out of wedlock and with foreign elements.Additionally, the father must be present during the parentage certification process, and his information must be properly filled in when registering the birth.
Can my child have a foreign name on a Vietnamese Birth Certificate?
Yes. According to Point c, Clause 1, Section III of Circular No. 1/2008/TT-BTP, parents can choose either a fully Vietnamese name or a combination of a Vietnamese and foreign name (e.g., Nguyen Thien Annie) for their child, depending on their preference.
Can our child have foreign nationality if born in Vietnam without marriage registration?
According to Article 16 of the Vietnamese Nationality Law, a child will be granted Vietnamese nationality if the parents agree. Whether the child also holds foreign nationality depends on the nationality laws of the parents’ home country.
What is the time limit for applying for a Birth Certificate and fulfilling the birth registration obligation?
Parents must apply for a Birth Certificate within 60 days from the child’s date of birth. If parents are unavailable, grandparents or other relatives may apply on their behalf.
