FAQ on Translation & Notarization in Vietnam
What is notarization?
Notarization is the formal certification by a notary of the authenticity and legality of a contract, transaction, or translation. It confirms the document’s accuracy, compliance with the law, and social ethics. Notarized documents are legally recognized and can be used as official records in legal matters.
When are notarized documents legally valid in Vietnam?
Notarized documents in Vietnam are legally valid from the moment the notary signs them and affixes the seal of their notarial practice organization.
A notarized contract or transaction becomes binding for the involved parties, and if an obligated party fails to fulfill their obligations, the other party can request a court to resolve the issue according to the law, unless otherwise agreed by the parties involved.
Notarized contracts and transactions can be used as legal evidence. The details and circumstances of these documents do not need to be proven unless declared invalid by a court.
Notarized translations are considered legally valid and can be used as their translated papers or documents.
(Articles 2 and 5 of the Law on Notary 2014)
How should a notarized translation appear?
To be considered valid, notarized translations must include the signature of the translator, which should be registered at the justice office in Vietnam. The translator must confirm that the documents are accurately translated.
Additionally, the translated documents should have an extract translation from the original copies and must display the justice office seal. It is essential that the document includes a specific certification number and the date of certification.
What are the principles of notarial practice in Vietnam?
According to Article 4 of the Law on Notarization 2014, the principles of notarial practice in Vietnam include:
Compliance with the Constitution and laws.
Objectivity and honesty.
Adherence to notarial practice ethics.
Taking responsibility before the law and the notary requesters for notarized documents.
